Monitoring Trustee in Case No COMP/M.6447 IAG/bmi
CompetitionRx (a wholly-owned subsidiary of Mazars LLP) is the Monitoring Trustee (“Trustee”) for the monitoring of the Commitments given by International Consolidated Airlines Group, S.A. (IAG) to the European Commission (“Commission”) for the acquisition of British Midland Limited (bmi) on 30 March 2012 (Case No COMP/M.6447).

The general responsibilities of the Trustee are set out in Clause 6.2 of the Commitments. The Trustee also has specific responsibilities with respect to each commitment which are set out in the relevant sections of the Commitments.
Slot Release Procedure
Under the Commitments, an Applicant requesting slots under the Slot Release Procedure is first required to follow the three steps set out in Clause 1.4.1 of the Commitments at least seven (7) weeks before the Slot Request Submission Deadline (“SRSD”) for the first IATA season for which they are applying for slots. The SRSD for the IATA Winter Season 2021/22 is Thursday 13 May 2021 and therefore the deadline for applications is 25 March 2021.
The Trustee will open the application process under the Slot Release Procedure of the Commitments on 25 February 2021. Applications for slots for Winter Season 2021/22 must be received by the Trustee by Close of Business (COB) on Thursday 25 March 2021. The COB deadline for applications is 6pm Greenwich Mean Time (GMT). Applications received after this deadline will be rejected.
Under the Commitments, Applicants are entitled to apply to operate the following city pairs:
- London – Aberdeen
- London – Edinburgh
- London – Nice
- London – Cairo
- London – Moscow
- London – Riyadh
For the IATA Winter Season 2021/22, five (5) slot pairs will be available for each day of the week. In addition, there will be four (4) slots pairs available on Saturday only and two (2) slot pairs available on Sunday only (41 slot pairs in total). These slot pairs may be used for operations on London Heathrow-Aberdeen, London Heathrow-Edinburgh, London Heathrow-Nice, London Heathrow-Cairo, London Heathrow-Moscow and London Heathrow-Riyadh only. The details of the application and selection procedure are set out in Clause 1.4 of the Commitments.
However, potential applicants showing interest are advised of the fact that the rights to these slots on offer are contested. There is therefore a risk that the slots will ultimately not be available to remedy applicants.

Applicants are allowed to request anonymity for their slots requests under the Slot Release Procedure as set out in Clauses 1.4.1(c) and 1.4.3 of the Commitments.
