Loss of profits claim
Lawyers acting for the defendant, a US company, instructed us to review a claim of £65m for loss of profits and punitive damages arising from the supply of infected chickens to a breeding company in India. The arbitration was heard under the auspices of the International Chamber of Commerce. We reviewed a large volume of accounting and production information and identified that the claim was based on inappropriate assumptions.
