Post-acquisition warranty dispute
We were instructed in an international arbitration for a dispute arising from the purchase of a large vehicle-leasing company by a subsidiary of a large listed European bank.
The dispute centred around 65 separate accounting errors, which formed the basis of a share sale warranty dispute of several hundred million dollars. The results of our work were presented in a format suitable for use in the International Chamber of Commerce. Our team was also significantly involved in the discovery process and the production of certain witness statements. One of our partners gave evidence over a two-day period. Recently our client was awarded $100m, the cap in the share purchase agreement.
