Alignment of penalty regimes and safeguards for certain excise duties

The reform of the penalty regimes for the remaining excise duties not already covered was announced today in the Budget completing the reform of measures initiated in Finance Act (FA) 2008.

The alignment was started in 2009 for direct taxes, and this Budget will replace current inconsistent rules for excise duties with penalty models designed to benefit timely filing and payment for all excise duties.

The taxes included in the announcement are as follows:

VAT landfill tax hydrocarbon oil duties lottery duty
insurance premium tax air passenger duty general betting duty gaming duty
aggregates levy alcoholic liquor duties pool betting duty remote gaming duty
climate change levy tobacco products duty bingo duty other excise duties

Further, for payers of excise duties on alcohol, tobacco, energy products, gambling duties and air passenger duty, measures have been announced for updating the compliance checking framework to align it with that for direct taxes in terms of record keeping, inspection and production of documents, and the ability to request information from banks.

Changes to time limits for HMRC to collect unpaid duties are proposed to come into effect from 1 April 2012 to reflect the need for a transitional period.
