Points Based System
Mazars’ international immigration services can assist high net worth individuals who wish to make a substantial financial investment in the UK to gain a Tier 1 Investor visa.
This can be achieved by investing £1,000,000 into UK government bonds, share capital or loan capital in active and trading companies that are registered in the UK. Up to £250,000 of this investment can be maintained in a UK bank account.
The qualifying applicant may have his own funds or borrow a £1,000,000 investment from a regulated financial institution provided he holds double the value of the loan.
Initial grants of status will be for 3 years and 4 months. Maintaining the £1,000,000 investment will allow Tier 1 investors to apply for an extension of leave to remain after 3 years and consider permanent settlement in the UK after 5 years.
Tier 1 Investors can take advantage of the accelerated route to settlement if they can meet certain conditions and make a greater investment:
Tier 1 Investors do not need a UK sponsor nor are they required to meet the English language requirements applicable to many other routes into the UK. However they are required to reach a minimum points threshold based on investment criteria.
Mazars can help secure a Tier 1 Entrepreneur visa for those with the intention of investing in the UK by setting up, taking over or being actively involved in the running of a business or businesses in the UK. The Tier 1 Entrepreneur can apply under this category if they can provide evidence:
Two business partners can qualify for Tier 1 Entrepreneur status together relying on the same investment, provided that they have equal control over the funds and/or the business.
Initial grants of status will be for 3 years and 4 months. An option to extend by a further 2 years exists although Tier 1 Entrepreneurs will also be able to settle in the UK after 3 years via the accelerated process if they create ten jobs or turn over £5m in a 3 year period.
Companies based in the UK who wish to recruit potential non-EEA employees must attain a Sponsorship License in order to do so.
Prior to attaining a Sponsorship License; a company must ensure human resource systems and procedures are in place to comply with sponsorship duties. Mazars Immigration Services is able to conduct audits of HR systems and assess the eligibility of becoming a sponsor.
Once a Sponsorship License is attained, the company to whom it is issued will be permitted to recruit foreign nationals. Mazars Immigration Services can assist with managing the sponsor management system including undertaking responsibilities of a Level 1 and 2 user and requesting and allocating Certificates of Sponsorships on behalf of our clients.
If an employer wishes to sponsor a skilled worker to work for their organisation in the UK, a skilled worker may be able to apply to come to the UK in order to carry out that employment.
The employer must be in possession of an Sponsorship License. The employee will need to be allocated a Certificate of Sponsorship in order to apply under the Tier 2 General category.
Employees of multi-national companies who are being transferred by an overseas employer to a UK based branch of the same organisation will require a visa in order to carry out the skilled job required.
The four sub-categories consist of:
Long Term Staff
The Long Term Staff category permits established, skilled employees of an overseas branch to transfer to work at an UK branch for a period of more than 12 months in order to fill a job that cannot be filled by the resident workforce.
Short Term Staff
This category is for established, skilled employees of an overseas branch to transfer to work at an UK branch for a period of less than 12 months in order to fill a job that cannot be filled by the resident workforce.
Graduate Trainee
The Graduate Trainee route permits transfer of recent graduate employees to a UK branch of the same organisation, as part of a structured graduate training programme which clearly defines progression towards a managerial or specialist role.
Skills Transfer
The Skills Transfer route permits the transfer of new graduates and skilled employees to a UK branch of the same organisation to learn the skills and knowledge required to perform their job overseas, or to convey their specialist skills or knowledge to the UK workforce.
Employees wishing to enter the UK under Tier 2 ICT must meet a requisite number of points.

Tier 2 Sportsperson permits elite sportspeople and coaches, established internationally at the highest level, who will make a significant contribution to the development in their sport, to enter and remain in the UK.
A Tier 2 Sportsperson will be required to be endorsed by their sport’s governing body. A Tier 2 Sportsperson must score a requisite number of points.
A migrant looking to study would be first required to apply to colleges and universities in the UK. A migrant will be able to enter, remain and study in the UK after successfully attaining a visa under the Tier 4 category.
The Tier 4 Child category permits children between four to seventeen years old to come to the UK in order to study.
Tier 4 Child must attain a requisite amount of points in order to come to the UK to study.
A foreign migrant wishing to come to the UK to carry out business for a short period of time may come to the UK without attaining sponsorship. Business Visitors are only permitted to carry out certain types of permissible activities.

This category permits a member of staff of a substantial trading company located outside the UK, which has no current UK presence to come to the UK with the intention to set up a wholly owned subsidiary or register a UK branch for an overseas parent company.
This category also permits a employee of an overseas newspaper, news agency or broadcasting organisation to come to the UK who is being posted on a long-term assignment as a representative of an overseas employer.

A foreign migrant may wish for their family members or relatives to accompany or join them for the duration of their stay in the UK. A dependent will need to meet requisite requirements in order to enter or remain in the UK.
A person who is present and settled in the UK or in possession of British Citizenship is permitted to bring their spouse or civil partner to the UK for the purposes of settlement.
A foreign national spouse or civil partner may be eligible to enter the UK indefinitely.

A fiancé (e) or proposed civil partner of a British Citizen or a person present or settled in the UK is permitted to enter the UK with the intention of getting married or registering their civil partnership within 6 months of their arrival to the UK.
After the marriage or registration of the civil partnership the fiancé (e) visa category permits settlement in the UK together afterwards.
If a foreign national who is present and settled in the UK or is a British national who wishes to bring their unmarried partner to the UK and settle with them they may be eligible to do so under this category.
European Economic Area Nationals
Nationals of countries in the European Economic Area (EEA) and Switzerland can come and reside in the UK travelling with their passport or national identity card. Nationals of countries in the EEA and Switzerland have no restrictions imposed on them in regards to employment or education.
EEA and Switzerland nationals must work, study, be seeking employment or self-sufficient in order to reside in the UK.
EEA and Switzerland nationals may confirm their right of residence in the UK by attaining a registration certificate.
An EEA national can have his non-EEA national family members and relatives join them in the UK. Non-EEA national family members and relatives must attain a family permit in order to join the EEA national in the UK.
Non-EEA national family members and relatives already in the UK will be required to make an application for a residence card to remain in the UK. Certain requisite requirements will need to be met prior to submitting an application.
An EEA national will become eligible for permanent residence once the EEA national has been residing in the UK for a continuous period of five years. The EEA national must also have been exercising their EC Treaty Rights during this period.
Non-EEA family members may also be eligible to obtain permanent residence.

A foreign migrant may be eligible for indefinite leave to remain after residing legally in the UK for a continuous period of three years or five years dependent on the immigration category the foreign migrant possesses.

In order to fulfil this requirement a foreign national can undertake the computer-based Life in the UK test. A foreign national is also able to take combined English for Speakers of Other Languages (ESOL) and citizenship classes to fulfil this requirement.
A foreign national who wishes to become a British citizen must first apply for naturalisation or registration as a British citizen.
In order to be eligible to apply for British naturalisation a foreign national must have been continuously residing in the UK for a period of more than five years. A foreign national married to a British citizen may be eligible to apply for British naturalisation after continuously residing in the UK for period of three years.
A foreign national must also meet other prerequisite requirements in order to be eligible to make an application for British naturalisation.
