HMRC Targets HSBC Swiss Offshore Bank Account Holders We understand that HMRC has gained access to account details for 15,000 HSBC account holders with offshore bank accounts with HMRC in Switzerland. The data was stolen from HSBC by an employee who passed it on to the tax authorities. HMRC are believed to be in the process of issuing enquiry notices to a significant number of UK individuals with such accounts. Civil Investigations of Fraud Process (code of Practice 9) In cases where HM Revenue & Customs suspects serious fraud, and where the tax at risk is believed to be more than £75,000, and as an alternative to a criminal investigation, HM Revenue & Customs can investigate using a process known as the Civil Investigation of Fraud (sometimes referred to as “CIF”) procedure. This procedure is set out in HM Revenue & Customs Code of Practice 9.
HM Revenue & Customs Specialist Investigations Unit Specialist Investigations is the “Premier League” of HM Revenue & Customs investigators, and is staffed by their most able and experienced investigators.

HM Revenue & Customs Criminal Investigations and Raids The nightmare scenario – 7am in the morning, fast asleep, and suddenly there is a loud knock on the door and officials from HM Revenue & Customs announce themselves, accompanied by Police officers, armed with a warrant to search your house and business premises, and you are placed under arrest and taken to a police station for questioning in connection with suspected tax fraud. Possible tax relief for “negative earnings”

An employee who had to repay part of a signing-on bonus to his employer has successfully challenged HMRC’s refusal to give him tax relief for the payment. It may seem obvious that a person who is taxed on receiving salary or bonus should be entitled to tax relief if they have to pay it back but that’s not the way that HMRC saw things. The taxpayer challenged the official view and has won his case in the tax First Tier Tribunal.

Public Accounts Committee tax avoidance report

The Public Accounts Committee has today published its report: “Tax avoidance: the role of large accountancy firms”. There are a number of issues highlighted by the report that have made headlines: firstly, the "cosy" relationship between the government and the Big Four accounting firms, and the conflict this presents between creating policy and advising clients how to circumvent the rules; and secondly, the award of government contracts to those firms that promote aggressive avoidance.

FHL and inheritance tax - the Pawson/Lockyer case

The Upper Tier Tribunal (UTT) ruling in HMRC’s favour in Revenue and Customs Commissioners (RCC) v Lockyer will have disappointed many owners of furnished holiday letting property who had hoped that business property relief (BPR) might apply to shield those properties from inheritance tax (IHT).

New residence rules bring new pitfalls

The long-awaited statutory residence test (SRT) is now effectively in place, even though it won’t be formally passed into law until the Finance Bill is passed, there are unlikely to be significant further changes. We have devoted a lot of coverage to the new residence tests, in our commentary on the 2013 budget and as the test has made its lengthy way from original proposal to almost-final legislation.
