Fund managers seminar - UCITS IV and AIFM Directives

A Mazars seminar for fund managers on the tax implications of projects relating to the UCITS IV and AIFM Directives.

05/12/2011

The provisions of UCITS IV are now implemented by national legislation and designed to enhance the cross-border promotion and management of UCITS funds.

The EU Directive on Alternative Investment Fund Managers (AIFM), due to be implemented in 2013, will affect managers of private equity, hedge, real estate, infrastructure and venture capital funds with total AUM over EUR 100 million (or over 500 million for unleveraged funds).

As we move towards a more 'open plan' European landscape, the fund management industry is gearing up to take advantage of the versatility of UCITS IV and is considering the opportunities, risks and compliance requirements arising from the AIFM Directive. Fund managers may even be weighing the advantages and disadvantages of both Directives in respect of certain “borderline” investment management strategies.

In this seminar our tax experts will discuss what safeguards must be put into place to ensure that a lucrative business case will not suffer a tax hit amidst these falling walls. Topics covered will be:

  • A UCITS IV project: Key tax risks for the fund management value chain
  • Seeking, meeting or avoiding the AIFMD: Tax pitfalls to watch
  • Transfer pricing in the wider European market place
  • Destination Ireland
  • VAT in a cross-border fund management operation
